BALLOT QUESTION

WHEREAS: The ASUW Constitution gives the power to the Board of Directors to propose ballot
questions to amend the constitution with a ⅔ vote of membership as stated in Article XIV, Section 1,
Subsection A;

WHEREAS: The ASUW Constitution Article XI, Section 2, Subsection D, Clause 2 states:

Any members of the Judicial Committee who intends to endorse or participate in any ASUW
election campaigning must resign their position by the first day of Spring quarter. If the
resignation does not take place, the Judicial Committee member will automatically forfeit their
position on the committee. This provision does not apply to the representative- at-large Board of
Directors member serving as chair or the ASUW President, but does apply to any proxies of the
ASUW President. Members of the Judicial Committee to which this clause does not apply must
be treated as though not a member of the Judicial Committee during the discussion and judgment
of election violations.

WHEREAS: When the constitutional amendment of 2017 was ratified by the student body that moved the
Board of Directors elections from the 7th week to the 4th week of Spring quarter, the date for Judicial
Committee members to step down from the committee was not changed to reflect the new election dates;

WHEREAS: The 2021 EPP states that candidates must file for candidacy and then certify on March 5th
and March 12th respectfully;

WHEREAS: The current language states that Judicial Committee members would have to step down on
March 29th, the first day of Spring quarter. Due to the current language, members would miss the dates
outlined in the EPP and would not be able to run;

WHEREAS: Prior EPP dates gave Judicial Committee members two weeks prior to the candidacy filing
and certification dates to resign to mitigate this conflict;

THEREFORE, BE IT ENACTED BY THE ASSOCIATED STUDENTS OF THE UNIVERSITY OF WASHINGTON BOARD OF DIRECTORS

THAT: The 120th Session of the ASUW Board of Directors submit the following question to the ASUW
Judicial Committee to be placed on the 2021 Election in the form of a Constitutional Amendment:

“Do you support the following change to the ASUW Constitution?

Any members of the Judicial Committee who intends to endorse or participate in any ASUW election
campaigning must resign their position 14 days before the candidate filing date in the EPP. If the
resignation does not take place, the Judicial Committee member will automatically forfeit their position
on the committee. This provision does not apply to the representative- at-large Board of Directors
member serving as chair or the ASUW President, but does apply to any proxies of the ASUW President.
Members of the Judicial Committee to which this clause does not apply must be treated as though not a
member of the Judicial Committee during the discussion and judgment of election violations.”
